The parties have settled their disputes and the Suit had been disposed of in terms of minutes of Consent Order which had been taken on record and marked 'X' for identification by an order dated 5th April, 2018. The parties have now submitted minutes of modified Consent Order dated 19th November, 2019. By the said minutes of modified consent order Sunshine Infraserv Pvt. Ltd. is proposed to be added as a 1/3

party to the Suit and the minutes of modified consent order has been executed for that purpose. The minutes of modified consent order are taken on record and marked 'X1' for identification. These are signed by the respective Advocates. 2.

The Suit is disposed of and decreed in terms of the minutes of the modified consent order. In view of the disposal of the Suit, all Interim Applications made by the parties are also disposed of.

Drawn up decree/ order is dispensed with unless the parties seek drawn up decree/ order, in which case they are entitled to apply.

Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules. He will act on production of an authenticated copy of this order without requiring a 2/3

separate application.

All concerned will act on production of a digitally signed copy of this order.
