Heard. The learned counsel for the Respondent filed Affidavit-in-Reply dated 14/01/2016. Same is taken on record.

This Notice of Motion is for appointment of Mr. Kamal Khata, as a sole arbitrator in respect of the dispute between the parties under the deed of partnership dated 25/06/2012 in place of Mr.Ashwin Shanker, who was earlier appointed as arbitrator.

The learned counsel for the Respondent in paragraph 2 of the Affidavit-in-Reply stated that they have no objection if the Notice of Motion is Basavraj G Patil 1/2

Hence, by consent, Notice of Motion is made absolute in terms of prayer clause (a) which reads thus:

(a) That this Hon'ble Court be pleased to nominate and appoint Mr. Kamal Khata as the sole arbitrator in respect of all disputes between the parties under the Deed of Partnership dated 25/06/2012.

Notice of Motion stands disposed off accordingly.
