Mr. Deshmukh states that the appeal and the stay application have been lodged on 6th December 2019 against an order passed by the CESTAT by which an order passed by the Commissioner of Customs to forfeit the security deposit has been set aside.

We see no reason to grant the prayer after almost 2 1⁄2 years of filing the application. There is no explanation also given in the application as to why such a stay has to be granted. If applicant had any genuine apprehension, they could have moved for urgent hearing of the interim application, which also has not been done.

Therefore, application dismissed.
