TESTAMENTARY AND INTESTATE JURISDICTION NOTICE OF MOTION NO. 15 OF 2017 IN TESTAMENTARY PETITION NO. 937 OF 2014 Smt. Snehlata Vasant Padloskar .. Deceased Shri Vikas Vasant Padloskar .. Petitioner/Applicant Mr.Narayan W. Gawade for petitioner/applicant. CORAM : K.R.SHRIRAM, J.
DATE : 12TH APRIL, 2017 P.C.
The petition is for restoration of the petition that came to be dismissed by an order dated 2nd May 2016 for non-removal of office objections. The Advocate on record states that it was due to personal ill health that the office objections were not removed and tenders a copy of the Certificate dated 24th November 2011 issued by Hira-Mongi Navneet Hospital, Mulund, Mumbai. The same is taken on record and marked 'X' for identification. In view thereof and for the reasons mentioned in the affidavit in support, the notice of motion is allowed in terms of prayer clauses (a), (b) and (c) and accordingly disposed.
The statement of Mr.Gawde that he will have all office objections removed within two weeks from today is accepted. It is made clear that if the office objections are not removed within two weeks from today, the petition will stand dismissed without further reference to the Court.
