Heard the learned counsel appearing for the applicant and the learned counsel appearing for the respondents. The appeal preferred by the applicant has been dismissed under the orders of the Prothonotary and Senior Master in exercise of powers under Rule 986 of the Bombay High Court (Original Side) Rules for non-removal of office objections. In view of the averments made in paragraphs 6 and 7 of the affidavit in support, a case for restoration is made out. Accordingly, notice of motion is made absolute in terms of prayer (a) subject to condition of the applicant removing all office objections in the appeal and getting the appeal numbered within a period of one month from today.
