When this matter was called out, advocates for the Petitioner and the Respondent have tendered the consent Minutes of Order dated 20 June, 2016, which have been duly signed by the Advocates of the Petitioner as well as the Advocates for the Respondent Company.
The Minutes of Order provide that the Petitioner has agreed to accept a sum of Rs.3.15 Croes in full and final settlement of Pg 1 of 2
5.cp.34.2016.doc its dues in installments as more particularly set out in paragraph 2 of the Minutes of Order.
The consent Minutes of Order dated 20 June, 2016 are taken on record and marked "X" for identification. The Company Petition is disposed of in terms of the consent Minutes of Order. The undertakings, if any, in the said consent Minutes of Order dated 20 June, 2016 are accepted.
In the event of any default as contemplated in the consent Minutes of Order, liberty to the Petitioner to revive the Company Petition and apply for advertisement etc. In view of the aforesaid consent Minutes of Order, nothing survives in the Company Application and the same is disposed of accordingly.
