The parties are present in court. Learned Counsel for the Plaintiffs seeks to withdraw the suit as against Defendant No.3 and prays for a decree in terms of the consent terms as between the Plaintiffs and Defendant Nos.1 and 2. The consent terms are taken on record, marked "X" for identification. The statements and undertakings contained therein are accepted. The suit is dismissed as not pressed against Defendant No.3 and disposed of in terms of the consent terms as against Defendant Nos.1 and 2.

In view of disposal of the suit, the notice of motion does not survive and the same is also disposed of.
