Respondent's counsel state that the order passed today in WP (L) No. 3972 of 2018 also seals the fate of the present matter. Counsel for the petitioner however, states that the facts are somewhat different.

Respondent no. 5 points out that identical petition is already filed on appellate side and it is pending. That petition is Stamped No.31508 of 2018. Counsel for the petitioner fairly states that nilegaonkar 1/2

As the controversy is between the same parties, we grant petitioner leave to seek amendment in the pending writ petition on appellate side. With that leave, we dispose of the present writ petition.
