Ms.Goldie Sud, party in person submits that all the defendants are duly served. Affidavit of Service is already filed in the Registry.

This application is preferred by third party intervenor for joining him as party in Suit No.397 of 2014 on the ground that he is co-owner of the property involved in the present proceedings i.e. premises situated at 494, Linking Road, Bandra West, Mumbai 400 050. He submits that being a co-owner he is necessary party in the present proceeding.

Advocate for the plaintiff submits that she has no objection to join the applicant as defendant in the present proceeding. Statement is accepted. 5.

Considering the submission made by the party in person and no objection given by advocate for plaintiff, I am satisfied that party in person has made out a case for allowing the Chamber Summons. Hence, following order is passed:

a) Plaintiff to join applicant Goldie Sud as defendant no.10 in Suit No.397 of 2014.

b) Amendment be carried out in plaint as well as Chamber Summons within two weeks from today.

c) Re-verification is dispensed with.

d) Amended copy of plaint and Notice of Motion if any be served on defendants immediately thereafter.

e) Liberty granted to the party in person to file written statement in Suit No.394 of 2014 within 8 weeks and affidavit in reply if any, in pending Notice of Motions with 4 weeks with copy to other side.

f) Chamber Summons stand disposed of accordingly.

g) No order as to costs.
