Heard learned Counsel appearing for the Applicant / Plaintiff.

By this Interim Application, the Applicant is seeking an injunction restraining the Defendants from preventing the Plaintiff allotting the shop No.58 on ground floor in building known as Xth Central (Mall) Shopping Centre, situated at Mahavir Nagar, Kandivali 1/2

4-ia-2157-2019.doc West, Mumbai 400 101 which is standing in the names of Plaintiff and Defendant No.1 purchased vide Sale Agreement dated 28th March, 2011 on leave and license basis and or by any other mode. This is the only prayer which the Applicant is seeking in the Interim Application.

The Defendant No.1 who is joint owner of subject shop No. 58 is present in Court and makes a statement that he will not prevent the Plaintiff from allotting the said shop No. 58 on leave and lincese basis and / or by way of any other mode, other than sale of the said shop. The above statement is accepted. 4.

In view of the above statement, the Interim Application is disposed of.
