Mr. Saraogi, counsel for defendant states that the written statement has been declared on 18.02.2019 and undertakes to file the same in the registry by tomorrow, i.e., 15.06.2019. Mr. Saraogi states that a copy of the written statement and additional affidavit in reply have been handed over to plaintiff's advocate in Court today.

As regards notice of motion no.440 of 2019, Mr. Pathare and Mr. Saraogi state that the order dated 08.01.2019 read with order dated 22.01.2019 be confirmed as order in the notice of motion and notice of motion be disposed.

Therefore, the order dated 08.01.2019 read with order dated 22.01.2019 is confirmed as order in the notice of motion and notice of motion accordingly stands disposed.

On or before 02.07.2019 statement of admission and denial with reasons for denial to be exchanged. If the statement of admission and denial is not given, parties shall be deemed to have admitted the existence of all the documents of the other side. Suit be listed for issues on 08.07.2019 on which date parties shall come with agreed draft issues and a separate list of issues on which they are unable to agree.
