As recorded in the order dated 2.12.2015, the respondent has deposited Rs.75 lakhs with the Prothonotary and Senior Master. The present application is to permit the petitioner to withdraw the sum of Rs.71,89,388/- out of this Rs.75 lakhs and transfer the balance to the account against the suit that the petitioner has filed bearing No.672 of 2015 pending in this Court.

The counsel for the respondent states that instead of doing these piecemeal arrangements, let the petitioner be allowed to withdraw this Rs.75 lakhs. The counsel for the petitioner is also agreeable for the same. Shraddha Talekar PA 1/2

906.CAL.852.2015.doc In the circumstances, the application stands disposed with the following order :

(a) The petitioner is permitted to withdraw a sum of Rs.75 lakhs deposited by the respondent with the Prothnotoary and Senior Master, High Court Bombay. (b) If the amount has already been invested in the fixed deposits, the Prothonotary and Senior Master to foreclose the fixed together with any accumulated interest deposits and handover the amount of Rs.75 lakhs to the petitioner under advice to the respondent. Notwithstanding the disposal of the company application, the applicant to remove all office objections and have the application numbered within one week from today The company application accordingly stands disposed. All concerned to act on an ordinary copy of this order duly authenticated by the Associate of the Court.
