On instructions, Mr Khandeparkar for the Plaintiff seeks leave to withdraw the summons for judgment. The Summons for Judgment is dismissed as withdrawn.

He requests that since the controversy is narrow the trial of the commercial summary suit may be expedited. The request is reasonable. For his part Dr Chandrachud for the Defendant states 20th March 2019

The commercial summary suit will be listed for framing issues on 22nd April 2019.

I am also now taking the liberty of stating in advance that the Plaintiff will have until 29th April 2019 to file and serve the Evidence Affidavit of its first witness, its Affidavit of Documents and Compilation of Documents and that I propose to take up the matter for marking the Plaintiff's documents and directions as to trial on 2nd May 2019.
