For the reasons set out in the Affidavit in support of the Notice of Motion, the Notice of Motion is allowed in terms of prayer clause (a), which is reproduced hereunder : "(a) That this Hon'ble Court condone the delay in filing the Written Statement on behalf of the Defendant and that the Written Statement be taken on record".

Place the above Suit for framing of issues along with Suit No. 109 of 2014 on 28 th January, 2016.
