This Notice of Motion seeks to set aside the order dated 6th August, 2015, passed by the Prothonotary and Senior Master rejecting their appeal under Rule 986 of the Bombay High Court Original Side Rules.

We have perused the affidavit in support of Motion and find that the objections had been removed before 3rd September, 2015 as specified in the order dated 6th August, 2015. However, in view of pending Notice of Motion No.941, the appeal was not numbered and registered.

In above circumstances, Notice of Motion is allowed in terms of prayer clause (a).
