The Petitioner has challenged the interim order passed in Original Application No.409 of 2015, which is pending before the Central Administrative Tribunal, Mumbai. After hearing the Petitioner and after going through the reasons including the fact that this is a case of nondeclaration of essential information and/or as stated to be suppression of factual information in the Attestation Form which could have, in a given case, disqualified the Petitioner for the appointment in question. Though initially ad-interim relief was granted, but by the impugned reasoned order taking note of rival contentions and the material placed on record the same has been vacated. Therefore, no case is made out to interfere with the said reasoned order. However, all points are kept open including the case of the Petitioner of claiming right on the Post, if the case is made out.
