Learned Counsel for the petitioner submits that after filing of this petition, the impugned communication dated 19th October 2015 has been withdrawn by the respondent No.1 vide its letter dated 5th January 2016 (Exh.-1) filed with the reply. 2] In these circumstances, according to the learned Counsel for the petitioner, now nothing survives in this petition. He, therefore, seeks to withdraw this petition as the same having become infructuous.

YBG 21-os-wp-3114-15 3] Prayer is accepted. The petition is dismissed as infructuous. 4] Needless to observe that in view of the said communication dated 5th January 2016, the society is free to take a decision in the matter in accordance with law.
