1] Learned counsel for the parties have tendered Consent Terms, whereby the parties have agreed to refer the disputes for adjudication by the sole arbitrator. The consent terms are taken on record and marked "X" for identification.
2] In view of the consent terms as arrived between the parties the application is disposed of by the following order:- Order i] Mr Anil R. Mehta, Advocate, is appointed as the prospective sole Arbitrator to adjudicate the disputes and differences between the parties, arising under the agreement dated 8th August, 2008 and 23rd July, 2008;
ii] The prospective sole arbitrator, fifteen days before entering 1/2
904 ARBAP 16 OF 2019 the arbitration reference, shall forward a statement of disclosure as per the provisions of Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996, to the Prothonotary & Senior Master of this Court, to be placed on record of these applications with a copy to be forwarded to both the parties; iii)At the first instance, the parties shall appear before the prospective arbitrator within 10 days from today at a date and time as may be fixed by the prospective arbitrator; iv) All contentions of the parties including on merits of the matter are expressly kept open;
(iv)The Arbitration petition is disposed of in the above terms. No costs.
