This Notice of Motion seeks to set aside the order dated 22nd January 2015, passed under Rule 986 of the Bombay High Court (Original Side) Rules, rejecting the Appellant's appeal for failure to remove the office objections on or before 5th February, 2015. Besides, also seeking condonation of delay of ten months in taking out the present Notice of Motion for the above relief.

We have perused the affidavit filed in support of the Notice of Motion indicating the reasons for non-removal of office objections and the delay caused in moving the Notice of Motion. We have satisfied with the explanation offered in support of the Notice of Motion for non-removal of office objections within the time directed as well as with the reason for the delay in moving the Notice of Motion seeking to set aside the order dated 22nd January 2015.

In the above view, we allow the Notice of Motion in terms of prayer clauses (a) and (b).
