This Chamber Summons is taken out by the Plaintiff for impleadment of the Defendant's liquidator. The Defendant is a co-operative society registered under the Maharashtra Co-operative Societies Act, which is ordered to be dissolved and a liquidator is appointed in respect thereof. The Chamber Summons and affidavit in support thereof have been duly served on the liquidator. An affidavit in proof of such service is tendered by learned counsel for the Plaintiff. The liquidator is absent despite service. For the reasons stated in the affidavit in support of the Chamber Summons, the Chamber Summons is made absolute in terms of prayer clause (a). Amendment to be carried out within two weeks from today. The amended copy of the plaint be served on the substituted Defendant. The substituted Defendant to file his written statement within a period of six weeks from today. The suit to come up on board for directions after six weeks.
