Learned Counsel for the applicants has tendered consent terms between the parties. She states that in view of this consent term, the disputes between the parties being the subject matter of this application stand resolved. A copy of the consent term is taken on record and marked "X" for identification.

It was pointed out to the learned Counsel for the applicants that the title and more particularly the name of the applicants as appearing in the consent terms is different from the title of the application of the present proceedings. She responds and submits that though the name of M/s.Naraina S. Fugro alongwith Yatin Keshav Fugro has been mentioned as the claimants, however, the consent terms

Pvr 2 12ARBAP44-16.doc entered between the parties are very much in respect of the dispute which is the subject matter of this application namely "Goa Petroleum Centre & Anr. vs. Kishoriben Narayan Fugro." Statement is accepted. 3.

In the circumstances, the arbitration application would not warrant adjudication, in view of the consent terms entered between the parties. It is accordingly, disposed of. No costs. (G.S.KULKARNI, J.)
