Heard the counsel for petitioner and also considered the averments in the petition. From the averments contained in the petition, I am satisfied that no notice is required to be given. From the averments, it also appears that there is an element of urgency. In the circumstances, petition is accepted and also allowed in terms of prayer clauses - (a), (b) and (bb) which read as under : (a) That the petitioner be appointed as the natural guardian of the minor and undivided 1/4th share, right, title and interest of the minor in the immovable property, viz., Flat No.704, adm. 417 sq. ft. carpet area on the 7th floor in "E" wing of the building known as "MAYURESH PARK TULIP E AND E CO-OP. HSG.

SOC. LTD." situate at Plot No.114, Lake Road, Bhandup (W), Mumbai 400 078.

(b) That the petitioner as such natural guardian of the minor be allowed to sale or transfer the undivided 1/4th share, right, title and interest of the minor in the immovable property, viz., Flat No.704, adm. 417 sq. ft. carpet area on the 7th floor in "E" wing of the building Gauri Gaekwad

HSG. SOC. LTD." situate at Plot No.114, Lake Road, Bhandup (W), Mumbai 400 078 of the minor and to execute Agreement for Sale, Sale deed or any other documents in favour of the proposed buyers as purchasers.

(bb) Issuance of notice under Section 31(4) of the Guardian and Wards Act, 1890 may be dispensed with. Petition to be numbered within a period of two weeks from today and this order will take effect soon the petition being numbered. All to act on authenticated copy of this order. (K.R. SHRIRAM, J.)
