Learned counsel for the defendant informs this Court that he has in his custody the resolution passed by the defendant for settling the matter and for the consent minutes of order.

The Vakalatnama shall be placed on record within two weeks from today.

The parties have settled their disputes. Consent minutes of order signed by the respective counsel for the parties are handed over. The same 1/2

902_COMIPL_24250_22.doc are taken on record and marked 'X' for identification. The consent minutes of order are found to be in order. The undertakings given in the consent minutes of order are accepted as undertakings to the Court. 4.

The suit is decreed as per the consent minutes of order. A soft copy of the consent minutes of order shall be uploaded as second order in the matter. A hard copy of the consent minutes of order, duly signed by respective counsel for the parties shall be retained in the record and shall not be sent for destruction in the usual course.

In view of the disposal of the suit, the Court Receiver's Report is disposed of and the Court Receiver stands discharged, without passing up of accounts and upon payment of costs and charges. 6.

The Court fees shall be refunded as per the rules. For the purpose of Section 43 of the Maharashtra Court Fees Act and the proviso thereto, today's date shall be the date of making a claim for repayment. The Prothonotary and Senior Master shall proceed to issue a certificate for refund of Court fees, on the basis of an authenticated copy of this order, without insisting upon a separate application.

Pending applications, if any, stand disposed of in view of the disposal of the suit.
