This Chamber Summons has been filed by the Applicant (original Respondent before the Arbitral Tribunal) to allow the Applicant to amend the Arbitration Petition in terms of the schedule annexed to the Chamber Summons. This Chamber Summons is necessitated in view of the fact that the Applicant's name has once again been changed from "E-Billing Solutions Pvt. Ltd." to "Ingenico ePayments India Pvt. Ltd." Learned advocate appearing on behalf of the Respondents, on instructions, states that he has no objection if the Chamber Pg 1 of 2
5.chscd.22.2019.doc Summons is allowed. He further states that all rights and contentions of the Respondents be kept open in the proceedings, either filed or to be filed, between the parties.
Keeping all contentions of the Respondents open in all proceedings already filed or to be filed between the parties, the Chamber Summons is allowed in terms of prayer clauses (a) & (b). The amendment to be carried out on or before 16th January, 2019 and serve the amended copy of the Arbitration Petition on the advocates of the Respondents. The Chamber Summons is disposed of in the aforesaid terms. No order as to costs.
I am informed that the connected Arbitration Petition, namely, Comm. Arbitration Petition No. 626 of 2018 is listed on 18th January, 2019. In these circumstances, list this Arbitration Petition also on 18th January, 2019 along with Comm. Arbitration Petition No. 626 of 2018.
