This Appeal filed under section 37 of the Arbitration and Conciliation Act, 1996 assails an order dated 14 th September, 2013 passed by a sole arbitrator under section 17 of the Act. At the hearing of this petition the learned counsel for the parties state that the final award is already been made and that the award is now subject matter of challenge in Commercial Arbitration Petition 546 of 2016 which is pending before this Court. Accordingly, I pass the following order : (i) This Arbitration petition is therefore disposed since nothing survives in this petition.

(ii) No costs.
