Perused the Notice of Motion and the Affidavit in support thereto. For the reasons set out in the Affidavit in support of the Notice of Motion, the Notice of Motion is allowed in terms of prayer Clause (a), which is reproduced hereunder : "(a) That by an order of this Hon'ble Court the order dated 16th November, 2015 passed by learned Prothonotary and Senior Master may be kindly set aside and present Suit (L) No. 1186 of 2014 kindly be restored to file and be heard on merits". 2.

The learned Advocate appearing for the Plaintiff states that he is ready with the requisite stamp papers to pay the deficit Court fee of Rs.1,18,270/-. Other objections shall be removed on or before 22 nd January, 2016.
