By an order dated 27 July, 2016, this Court had recorded that consent terms were arrived at between the Petitioner and the Respondent Company and cheques were also handed over to the Petitioner for repayment of the amounts mentioned in the consent terms. Thereafter, the matter was placed on board on 1 August, 2016. On the said date (1 August, 2016), this Court was informed that the cheques handed over by the Respondent Company to the Petitioner were dishonoured. However, the learned advocate appearing on behalf of the Respondent Company stated on the said date that he was trying to ensure that this payment is immediately made to the Petitioner. In the light of this statement, the matter was Pg 1 of 2

Today, the learned advocate for the Respondent Company states that they have handed over "Pay Orders" in lieu of the dishonoured cheques, which pay orders have been duly honoured and the Petitioner has received the entire amount as mentioned in the consent terms dated 27 July, 2016. Learned advocate appearing on behalf of the Petitioner confirms this fact and states that they now have no claim against the Respondent Company. In view of the aforesaid statement and considering that the claim of the Petitioner has been settled, nothing survives in this Company Petition and the same is disposed of accordingly. No order as to costs.
