The counsel for petitioner and respondent state that parties have amicably settled and tenders consent terms dated 18th April 2018. The consent terms signed by the Partner of petitioner firm, Director of respondent company and their respective advocates is taken on record and marked 'X' for identification. Both counsel state that the signatories to the consent terms are present in Court.

Order in terms of the consent terms. All undertakings accepted. Shri Modi, Director of respondent, who is present in Court personally undertakes for himself, on behalf of the company and the other directors of company that they will strictly comply with the requirements of clause 1 of Shraddha Talekar PS 1/2

901.cp.425.2016.doc the consent terms and in case of default, apart from petitioner's right to apply to the Court for revival of this petition, petitioner may also execute this consent terms as decree as against Shri Modi, all other directors of the company and on behalf of the company. Statement of Shri Modi is accepted as an undertaking to this Court.

Since the petition is at pre-admission stage, petition disposed as withdrawn with liberty as prayed for revival of the petition, in case of default.
