Mr.Joquim Reis, Sr.Advocate a/w Mr.Denzil Dmello for defendants. ---- CORAM : K.R.SHRIRAM,J DATE : 15.6.2016 P.C.:- Mr.Dmello for the defendants states that some more time is required for the parties to resolve the dispute inter se. Ms.Sheetal Kumar for the plaintiffs states that Chamber summons No.1715/2015 is to direct the defendants to give inspection of documents based on which they are claiming rights over the property. The documents are listed in the chamber summons. Mr.Dmello states that they have given inspection of all such documents which are in their possession and there are no documents which they have refused to give inspection though it is in their possession. He also states that for example item T(i) of Exhibit C to KJ
chs1715.15-3 the affidavit in support of chamber summons, the plaintiff is asking for bank account of payments and cheques etc. The counsel for the plaintiff clarifies that what they are seeking is the details of payment, cheques paid for the deeds/indentures/conveyance. It is also submitted by the defendants that in view of this clarification they will give details of the cheques/payments. It is made absolutely clear that in view of the statement made by the defendants that they have not refused inspection of the documents which are in their possession, the defendants will not be permitted to rely on any such documents of which if it comes to light, inspection was not given but they were in their possession.
In view of the above order the counsel for the plaintiff states that Chamber summons No.1715 of 2015 may be disposed. Chamber summons No.1715 of 2015 disposed accordingly. (K.R.SHRIRAM,J) KJ
