When the matter was called out on the last occasion, it was stood over to enable the Respondents to take instructions. After taking instructions, learned Counsel for the Respondents agrees to a remand. Accordingly, by consent, the impugned award dated 30 October 2011 is quashed and set aside and the reference is remanded for a fresh hearing in accordance with law. Since the original sole arbitrator is no longer available, a new arbitrator shall be appointed in accordance with the contract between the parties. The reference shall be conducted with due notice to the Petitioner. All rights and contentions of the parties on merits are kept open.
