Heard the learned counsel for the applicant. The Notice of Motion is opposed by the learned counsel for the respondent.

According to the respondent, the delay in preferring the Appeal is not merely of 12 days. We have perused the affidavit in support of the Notice of Motion and in particular paragraphs 3 to 5 thereof.

Sufficient cause is made out for condonation of delay. Notice of Motion is made absolute in terms of prayer clause (a).

The Appeal shall be listed on the

nma39 date fixed as per the C.M.I.S after all office objections are removed and the appeal is numbered.
