Mr. Rushabh Thacker, learned counsel for the petitioner submits that in the present case, the petitioner has filed a probate petition and also a petition for grant of succession certificate. 3.

The learned counsel for the petitioner, on instructions, seeks permission to withdraw the probate petition i.e. Testamentary Petition No.3211 of 2023, in order to pursue Testamentary Petition (L) No.36278 of 2022.

In view of the above, Testamentary Petition No.3211 of 2023 is disposed of as withdrawn with liberty to the petitioner to pursue Testamentary Petition (L) No.36278 of 2022.

The court fees paid in Testamentary Petition No.3211 of 2023 shall be refunded to the petitioner as per Rules. 6.

The praecipe is disposed of.
