Heard Mr. Konar, learned Advocate for Petitioners. 2.

Present Misc. Petition is filed by the Petitioners for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of deceased Ravindra Pratap Singh S/o. Shiv Pujan Singh. The names of the legal heirs of the deceased are mentioned in paragraph No. 4 of the Petition. Petitioners before the Court are all legal heirs namely wife (widow), daughter and two sons. Purpose for filing the present Petition is stated in paragraph No. 9 of the Petition. I have perused the same. I see no impediment in granting legal heirship certificate dispensing with the requirement of service considering that all four Petitioners are before me.

In view of the above, present Misc. Petition is allowed and disposed of in terms of prayer clauses (a) which reads thus:- "(a) That a Legal Heirship Certificate be issued under the provision of

MPT-66-23.doc Bombay Regulation Act VIII of 1827, certifying that (1) Vimala Ravindra Pratap Singh (being the widow of the deceased and Petitioner No. 1 herein), (2) Neelima Ravindra Pratap Singh (being the daughter of the deceased and Petitioner No. 2 herein), Rajesh Ravindra Pratap Singh (being the son of the deceased and Petitioner No. 3 herein) and Deepak Ravindra Pratap Singh (being the son of the deceased and Petitioner No.4 herein) are the only heirs and legal representatives of the deceased abovenamed." 4.

Issuance of proclamation stands dispensed with. [ MILIND N. JADHAV, J. ] Amberkar
