THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr.Ghuge Jitendra N AGP for Respondents/State: Mr.S.K. Kadam.
Advocate for Respondents 3 & 4: Mrs.Ghule Renuka V. ...
CORAM : S.S. SHINDE & A.M. BADAR, JJ.
Dated: SEPTEMBER 22, 2015 ...
This contempt petition alleges disobedience of the order passed by this Court on 29th August, 2012 in Writ Petition No.5643 of 2012. This Court, on 31st August, 2015 issued show cause notice to respondent No.3 and the Chief Executive Officer - respondent No.3 was directed to remain present before this Court. Accordingly, the respondent No.3 is present before this Court today.
The affidavit-in-reply has been filed on behalf of respondents 3 to 5 and it is brought to the notice
211.14cp of this Court that on 19th/20th October, 2012 by letter the Chief Executive Officer, Zilla Parishad, Parbhani - respondent No.3 communicated the petitioner the decision taken in adherence to the directions issued by this Court.
In our opinion, once such decision was communicated to the petitioner by respondent No.3, this contempt petition should not have been filed by the petitioner after two years from date of communication of decision. We deprecate the practice of filing such petitions knowing fully that order of which disobedience is alleged, has been complied with.
In the light of above, contempt petition stands disposed of.
