DATED : 6TH MAY, 2015 ORDER :- This is an application for grant of anticipatory bail since the applicant is apprehending his arrest in connection with Crime No.26/2015 registered at Mohadi police station, Dist.Dhule for offences punishable under Sections 324, 504, 506, 307 r.w. 34 of I.P.C. The First Information Report is lodged by Gopal Gawali. The First Information Report clearly attributes a specific role that the first informant was assaulted on his head by iron rod by one Dhiraj who is already released on bail by the trial Court. This statement is made by learned APP for the State on the basis of instructions from investigating officer who is personally present in the Court. Further as per the accusation made in the First Information Report present applicant made an assault by stone on the first informant.
The injury certificate of first informant Gopal does not reflect any injury corresponding to the assault of stone. The injury that is displaced fracture on the Parietal bone which is corresponding to the external injury Contused Lacerated Wound on head 3x0.5x0.2 cm. clearly attributable to the assault by the iron rod.
criapln2205-15 -2applicant has made out case for anticipatory bail. Hence application is allowed.
2] Applicant Ashok Mukaji Gawali be released on anticipatory bail in the event of his arrest in connection with Crime No.26/2015 registered at Mohadi police station, Dist.Dhule for offences punishable under Sections 324, 504, 506, 307 r.w. 34 of I.P.C., on he executing PR bond of Rs.5000/- with one solvent surety in the like amount.
3] The applicant shall attend police station twice a week preferably on every Sunday and every Tuesday in between 3 to 5 p.m. till the charge sheet is filed. Application is disposed of. (V.M.DESHPANDE,J.) umg/
