Heard the learned advocate Shri Kedar for the petitioner, the learned advocate Shri Narwadkar, who appears for respondent Nos.2 and 3 and the learned advocate Shri Dighe holding for the learned advocate Shri Kadam for respondent No.4.

Grievance of the petitioner is to the effect that pursuant to the Notice No.02- NEET PG 2024 dated 14.11.2024, she had applied for MD (Medicine) course and opted for respondent No.5 Institute in the CAP Round II. She was ready to pay fees as approved by respondent No.4 Fees Regulating Authority at the rate of Rs.10,50,000/- per year. However, she was demanded excess fees about which she made a grievance to respondent No.4 Fees Regulating Authority on 25.12.2024 and still by mail communication addressed by the Institute to respondent No.2 Admission Regulating Authority, she is stated to have not joined.

It is also being pointed out that similar grievance against the same Institute was raised by a candidate in the same admission process, who had opted for MS (Obstetrics & Gynaecology). She was also demanded fees of Rs.64 lac. She having made grievance to respondent No.4 Fees Regulating Authority, by resolution dated 24.12.2024 it had directed the Institute to grant admission to her by accepting ad hoc fees at the rate of Rs.10,50,000/- per year from the institutional quota, subject to the final outcome of Writ Petition No.18908/2024

Indeed, the petitioner seems to be sailing in the same boat as was the candidate, who was able to convince respondent No.4 Fees Regulating Authority and solicit appropriate orders. 6.
However, admittedly the last date for confirming admission in the CAP Round II is already over and in these peculiar circumstances, the learned advocate for the petitioner, on instructions, seeks leave to withdraw the writ petition with liberty to the petitioner to register and apply in CAP Round III wherein the period for filing the applications is between 04.01.2025 and 06.01.2025, and with liberty to file a fresh writ petition in case she is unable to confirm admission or the Institute refuses admission on the ground that she was not ready to pay excess fees demanded by the Institute, over and above what has been actually approved by respondent No.4 Fees Regulating Authority on 20.06.2024.

The Writ Petition is disposed of as withdrawn with liberties as prayed for.
