Heard learned counsel for the applicant and learned counsel appearing for the Acquiring Body. 2.

It is pointed out that in connected First Appeal No.2342/2014, already this Court has allowed withdrawal of compensation amount subject to certain conditions. Learned counsel for the Acquiring Body vehemently objected withdrawal of the deposited compensation amount. However, on the count of parity, permission is granted to the claimants to withdraw 25% of the deposited amount subject to filing of an

ca1493-2019 undertaking within a period of one month from the date of passing of this order that in the event the applicant is directed to deposit the amount, the applicant would deposit the same within one month. The applicant is further permitted to withdraw 75% of deposited amount on furnishing solvent surety/security/bank guarantee of any nationalized or scheduled bank in the like amount Civil Application is accordingly allowed and disposed of.
