VERSUS

The State of Maharashtra & others .. RESPONDENTS Mr. A.A. Mukhedkar, advocate for petitioners. Mr. A.B Girase, GP for the State.

===== CORAM : R.M. BORDE & A.I.S. CHEEMA, JJ.

DATE : 12th JANUARY, 2016.

PER COURT :

1.

This petition can be disposed of in view of affidavit-in-reply presented on behalf of respondent no. 3. In paragraph no. 5 of the reply, it is noted that when the complaints were received in respect of inclusion of names in the voters list, realising the practical difficulties, the Returning Officer postponed the programme for conducting election in Special General Body Meeting. It is further stated in paragraph no. 6 that the Returning Officer has decided to publish provisional list of voters within two weeks. Petitioners can raise their claims and objections in respect of the list and, after extending hearing, the claims and objections would be decided and final list of voters would be published. In view of reply tendered on behalf of respondent, the grievance raised by petitioners in the instant petition stands redressed. Writ petition stands disposed of. ( A.I.S. CHEEMA ) ( R. M.
