Shri Kulkarni, learned Advocate, submits that he has taken instructions from the Respondent Union at Aurangabad that the Petitioner and the Respondent have settled their dispute out of court. The Petitioner Factory at Aurangabad has been closed down more than 10 years ago pursuant to the out of court settlement between the parties. The members of the Respondent Union have been given their full and final dues at the time of closure of the Petitioner Factory.

He further submits that Shri R.P.Powar, learned Advocate for the Petitioner Factory, has retired from practice about two years ago. Considering the above, this petition need not be decided on it's merits. The petition is, therefore, disposed of. Rule is discharged.
