Applicant apprehends arrest in C.R. No. 14/2021, registered with Degloor Police Station, Dist. Nanded, for offences punishable under sections 498-A, 304-B, 504 r/w 34 of Indian Penal Code.

FIR is lodged by Sidram Sulfule alleging that marriage of deceased Pratibha with Sainath took place in the year 2007 and couple was blessed with a son. Pratibha was being ill treated by all the accused persons named in the FIR on account of demand of Rs. 1 Lakh for hotel business. On 04.01.2021, informant received a phone call from accused persons and it was informed that deceased Pratibha and her son Prajyot have fallen in the water and they have expired. Bhagyawant Punde

Heard learned advocate for applicant and learned APP for respondent.

Charge sheet in the present crime is filed on 04.03.2021. Applicant is the sister-in-law of deceased. Learned advocate for applicant has placed on record affidavit (Exhibit-7) filed by informant before the Trial Court, wherein he has stated that name of applicant is inadvertently mentioned in the FIR. 5.

Considering the gender of applicant and the fact that charge sheet is filed, nothing is to be recovered from applicant. Her pre-trial custodial detention is not necessary. All the accused persons are either released on regular bail or anticipatory bail. 6.

In the result, application is allowed by confirming interim protection granted to applicant by order dated 3rd January, 2024.
