Heard learned counsel for the applicant.

Learned counsel for the applicant refers to the reasons in the civil application and purports to point out that the applicant had been lying indisposed and as such the matter could not be filed in time.

Learned counsel for respondents purports to resist, however, is not in a position to contest veracity of the contents of the civil application, by producing any credible material.

In the circumstances, it is expedient to grant civil application. Civil application accordingly stands granted in terms of prayer clause (B) and is disposed of.
