DATE : 10th January, 2025 Per Court :- The petitioners are non teaching employees of private Ashram School. They are claiming benefits of various Government Resolutions providing for Assured Career Progression Scheme.

We have heard both the sides.

The issue is no longer res integra in the light of the judgment in the matter of Kiran Namdeo Shinde and others vs. The State of Maharashtra and others, Writ Petition No.2358/2013 and connected matters decided at the principal

*2* 933wp327o25 seat on 21.09.2013 and several other subsequent decisions of this Court.

It is trite law that there cannot be any discrimination against the employees like the petitioners from private aided Ashram schools when the benefits are being extended to similarly placed employees of the Government run Ashram schools.

In the light of above, the Writ Petition is allowed. The respondents shall consider the case of individual petitioners for grant of benefits of Assured Career Progression Scheme in the light of above observations as expeditiously as possible and in any case within six weeks.
