This application is filed for transfer of Hindu Marriage Petition No.249/2022 from 4th Civil Judge Senior Division At Kolhapur to Civil Judge Senior Division, Beed. Learned Counsel for applicant/ wife submits that considering distance between two places it would be inconvenient to her to travel and this will affect her right of defending case effectively. 2.

Learned Counsel for respondent submits that respondent/ husband is taking care of minor daughter, who is diagnosed cancer and hence it would not be in the interest of child to transfer proceedings from Kolhapur to Beed.

Learned Counsel for respondent, on instructions, makes a statement that the respondent would pay some of Rs.2000/- on each visit of the petitioner to Kolhapur for attending Hindu Marriage Petition No.249/2022. Learned Counsel for petitioner records her consent for the same.

The facts as they appear from record do not justify transfer of proceedings from Kolhapur to Beed. The interest of wife is taken care by husband bearing expenses of visit to Kolhapur to attend the proceedings.
