PER COURT :

The learned counsel for petitioner submits that the Head

{2} wp768-15.odt Master i.e. the respondent no.5 has submitted proposal to the Education Officer i.e. respondent no.3 seeking approval to the appointment of petitioner. The said proposal is submitted on 8/8/2014, however, as yet, no decision has been taken though the authority is duty bound to decide it within two months from the date of receipt of proposal.

2] Mr.Patil, learned AGP submits that if said proposal is pending, the Education Officer will decide it on its own merits. 3] In light of that, we pass following order :

a] In case the proposal forwarded by respondent no.5 seeking approval to the appointment of the petitioner [Exh.B] is pending consideration with respondent no.3 then respondent no.3 shall decide said proposal on its own merits in accordance with law expeditiously preferably within 3 months.

4] Writ Petition is disposed of. No costs.
