This application seeks condonation of delay caused in filing appeal against conviction. There are good reasons for condoning the delay, first and foremost is that the Appellant did not utilize his valuable right of first appeal against the judgment of conviction and sentence. He should be provided an opportunity to challenge the judgment against him. The second reason is also equally equitable. The other accused were acquitted and the State of Maharashtra has filed appeal against such acquittal. While appreciating the evidence in such appeal, it would be easy for the Court to appreciate material against the convicted accused. Therefore, delay is condoned. Appeal shall be registered. Criminal application stands disposed of.
