In CA/119/2024, as there is no objection to bring the legal heirs on record from other side, the application for bringing on record legal heirs is allowed by condoning delay of 583 days and the said application is disposed of.

Heard the learned Advocate for the petitioners. The learned Advocate for the respondent No.1 - Wakf Board submits that the Trial Court has not proceeded with the matter on account of interim order passed in this matter. He also submits that the suit itself is not

935 WP 3376-2015 maintainable and that he would move an appropriate application to that effect before the Trial Court.

If such an application is filed, the Trial Court is permitted to proceed with the application.

If such an application is filed for maintainability of the suit, the plaintiffs alone would be called in the matter to oppose the application. 6.

List the matter on 14/02/2024.
