After hearing learned Counsels for both sides and when this Court has shown disinclination to cause interference in the impugned order, learned Counsel for the Petitioner, on instructions, seeks withdrawal of the Petition with liberty to file fresh application under Order XXVI, Rule 9 of Code of Civil Procedure at appropriate stage of the suit.

Petition is dismissed as withdrawn with liberty as prayed.
