This is an application for modification of earlier order passed by this court. The learned counsel for the applicants pointed out that more than three persons bank account cannot be opened as per the bank rules and policy. Therefore, Registry could not transfer the said amount in the name of the claimants. He further pointed out affidavits of claimants Nilima Dilip Bendale, Smt. Vandana Sopan Narkhede, Smt. Rita Anil Patil, Madhukar Eknath Yewale, Ashok Eknath Yewale and Shailaja Prakash Yeole. He further pointed out that Shaileja is power of attorney holder of Aniket Prakash Yeole and Sanket Prakash Yeole. He, therefore,

2 911 ca 153-25 prayed to give direction to the Registry to permit to withdraw and transfer the amount in the name of Sanjay Baliram YewaleApplicant No.1B. 2.

Considering the reasons stated in the application and submissions of the learned counsel for the applicants, the application deserves to be allowed. The application is allowed in terms of prayer clauses-A & B and disposed of. 3.

The Registry is directed to deposit the amount in the name of applicant No.1B- Sanjay Baliram Yewale.
