Learned Counsel Mr.Thombre for the petitioner, on instructions, prays for withdrawal of the petition and further submits that as the District Collector, Beed is issuing fresh tenders, the petitioner may not be deprived of participating in the fresh tender process. This apprehension of the petitioner is already taken care by statement made in the affidavit in reply filed on behalf of respondent Nos. 1 and 2 through the Tahsildar (Revenue) Ms. Manisha Telbhate and the statement reads thus :-

( 2 ) wp125.19 "It is respectfully submitted by this respondent that fresh E-Tender notice is already issued and petitioner along with other bidders has every right and opportunity to take part in the tender process." 2.

In view of these facts, the petition is allowed to withdraw and disposed of as withdrawn.
