The proposals seeking approval to the transfer of petitioners from unaided to aided are rejected.

Heard the learned advocate for the petitioners and the learned A.G.P.

The proposals are rejected basically on the ground of Circular dated 28.06.2016.

This Court in its judgment dated 04.07.2019 in Writ Petition No. 1493/2018 with connected writ petitions has held that some of the clauses of the Circular dated 28.06.2016 would not apply and are erroneous.

In the light of that the impugned orders are quashed and set aside. The Education Officer shall reconsider the proposals seeking approval to the transfer of petitioners from unaided to aided on its own merits in tune with the judgment dated 04.07.2019 in Writ Petition No. 1493/2018 with connected writ petitions 5.
